Learn how HUD Guidance related to the potential for a disparate impact discrimination claim associated with landlord criminal screening, HUD's decision to find the potential for disparate impact on the basis of race and ethnicity due to criminal convictions, landlords' legitimate nondiscriminatory interest in screening criminals, and individualized assessments of tenants in order to maintain a least discriminatory procedure for criminal screening.
