Fair Housing Resources for Ohio Housing Providers

Fair housing compliance is part of everyday property operations, from leasing and advertising to maintenance, resident communication, policy enforcement, and accommodation requests. The Columbus Apartment Association provides resources and education to help multifamily housing professionals understand their responsibilities and support consistent, compliant practices across your teams.

Key Fair Housing Compliance Areas
Housing providers should define clear policies and follow consistent procedures in the areas where fair housing questions most often arise.

Reasonable Accommodations and Modifications: Residents with disabilities can request reasonable changes to help them access and live comfortably in their housing. For additional background, review the HUD/DOJ Joint Statement on Reasonable Accommodations and Joint Statement on Reasonable Modifications, which are still considered foundational guidance. 

Your property team should have a documented process to review and respond to these requests, helping ensure consistent evaluations, clear communication, and accurate recordkeeping.

Assistance Animals
Review animal-related accommodation requests under current federal, state, and local guidance. This area has changed significantly following HUD’s May 2026 enforcement guidance on animal-related reasonable accommodation requests.

HUD’s updated enforcement position indicates that, for Fair Housing Act complaints involving animal-related accommodations, FHEO will prioritize reasonable-cause findings and recommended charges in cases involving animals trained to provide disability-related assistance. HUD also states that untrained emotional support animals are not automatically treated the same as trained assistance animals for federal enforcement purposes.

​This does not mean housing providers should adopt blanket denial policies for emotional support animal requests. HUD’s memo addresses federal enforcement priorities and does not amend the Fair Housing Act itself, override state or local law, or prevent private lawsuits. Continue to review animal-related requests carefully, document decisions, and consult qualified legal counsel before making policy changes or denying a request.

Advertising and Resident Communication
Fair housing applies to marketing, leasing conversations, online listings, emails, text messages, other resident communications, and more.

Focus your advertising on the property, amenities, location, lease terms, and objective qualification standards. Be sure to avoid language that suggests a preference, limitation, or exclusion based on a protected class.

Occupancy Standards
Occupancy standards should be reasonable, consistently applied, documented, and reviewed against federal, state, and local fair housing guidance.

Written standards help leasing teams apply policies fairly, answer applicant questions consistently, and reduce the risk of inconsistent decision-making.

Accessibility and Maintenance
Properties must meet applicable accessibility requirements, respond consistently to maintenance requests, and document service practices that affect residents’ use and enjoyment of housing.

Train your maintenance teams, leasing teams, and property managers in understanding how accessibility, accommodations, communication, and service delivery can create fair housing considerations.

Fair Housing in Ohio
Ohio housing providers should understand both federal fair housing requirements and Ohio-specific protections. Fair housing complaints may be reviewed by federal, state, or local agencies, depending on the facts of the complaint and where the property is located.

The federal Fair Housing Act protects against discrimination based on race, color, national origin, religion, sex, disability, and familial status. In addition to federal protections, Ohio law includes ancestry and military status.

What is fair housing compliance?
